Cook Terms (Seller Agreement)
These Cook Terms (“Cook Terms”) apply when you register or operate as a Cook, Chef, or Kitchen on MyPeki, operated by Fonsaw Technologies Private Limited (“Fonsaw,” “we,” “us”). By onboarding as a Cook, you agree to these Cook Terms, our Terms of Service, Privacy Policy, and Refund & Cancellation Policy. Last updated: 1 July 2026.
1. Relationship
You are an independent food business operator, not an employee, agent, or partner of Fonsaw. You are responsible for preparing and supplying food you offer through MyPeki. Fonsaw provides the technology platform, payment facilitation, and related services described in the app.
You enter into a contract with the Food Lover for the food you supply. Fonsaw is not a party to that food supply contract except as stated in the Terms of Service regarding platform services and, where applicable, tax invoicing as an e-commerce operator under GST law.
2. Eligibility and FSSAI
- You must hold a valid FSSAI registration or license appropriate to your turnover and kind of business before listing your kitchen or dishes. You must provide accurate license or application details for verification.
- You may list and sell only food categories permitted under your FSSAI authorization.
- Your FSSAI license or registration number (or application reference, where applicable) will be displayed to Food Lovers as required by law and platform policy.
- You must comply with the Food Safety and Standards Act, 2006, applicable rules and regulations, and any FSSAI advisories relevant to e-commerce food businesses.
- You must notify us promptly if your FSSAI status changes, is suspended, or expires.
3. Listings, photos, and claims
- All dish names, descriptions, ingredients, allergen information, photos, prices, portions, and availability must be accurate and not misleading.
- Online claims must align with physical labels and packaging where applicable. Do not claim “organic,” “sugar-free,” or similar attributes unless properly substantiated.
- For pre-packaged or batch items (for example pickles or cakes), comply with labelling and shelf-life requirements. Products delivered should meet applicable remaining shelf-life rules.
- You grant Fonsaw a non-exclusive license to use listing content to operate, promote, and improve the Services.
4. Orders, acceptance, and fulfilment
- You must monitor order requests and accept or reject them within app time limits.
- Accepted orders must be prepared and handed off according to the delivery or pickup method selected.
- Maintain kitchen hygiene, safe handling, and temperature practices appropriate to the food you prepare.
- Communicate delays or issues promptly through in-app channels.
- Do not solicit off-platform payment or circumvent platform fees for orders originating on MyPeki.
5. Pricing, fees, and settlement
You set item prices subject to app rules. Fonsaw may charge platform or service fees and payment-processing costs as disclosed in the Cook dashboard or onboarding materials. Payouts are made to the bank account you provide, net of applicable fees, refunds, chargebacks, and adjustments, on the settlement schedule shown in the app.
You are responsible for your own income tax, GST registration (if required), and statutory filings except where Fonsaw is legally required to discharge tax as e-commerce operator for notified services under applicable GST law.
6. Cancellations and refunds
Cook-initiated cancellations after acceptance should be limited to genuine operational or safety reasons. Repeated cancellations may affect visibility or account status. Refunds to Food Lovers follow our Refund & Cancellation Policy and may be adjusted against your settlements.
7. Consumer information you must provide
You agree to provide Fonsaw with accurate information for display to Food Lovers, including:
- kitchen or business name and contact details;
- FSSAI license or registration details;
- principal place of preparation (as permitted and shown in the app); and
- any other details required under applicable e-commerce and consumer protection rules.
8. Grievance redressal (Cook support)
For Cook account, settlement, or policy questions, contact care@mypeki.com (subject: Grievance) or +91 97455 50666. We aim to acknowledge within 48 hours and resolve within 30 days where possible.
9. Suspension and termination
We may suspend or remove listings, withhold settlements pending investigation, or terminate Cook access for FSSAI non-compliance, food-safety risk, fraud, abuse, repeated cancellations, poor ratings tied to safety issues, or breach of these Cook Terms or the Terms of Service.
10. Indemnity
You will indemnify Fonsaw against claims, penalties, and losses arising from your food preparation, misrepresentation in listings, breach of food-safety law, or violation of third-party rights, except to the extent caused by Fonsaw’s wilful misconduct where not excludable by law.
11. Governing law
These Cook Terms are governed by the laws of India. Courts at Bengaluru, Karnataka have jurisdiction, subject to mandatory consumer forum jurisdiction where applicable.
